A society is a group of people who have come together via mutual consent to deliberate, govern, and act collaboratively for a common good. Typically, societies are formed to promote charity activities such as sports, music, culture, religion, art, education, and so forth.
Society Registration in India is governed by the Society Registration Act, which establishes particular procedures for society registration and operation. This legislation was enacted to supplement the legislative requirements for society registration for the growth of literature, fine arts, science, or the dissemination of information for beneficial purposes. Several state governments have approved the Society Registration Act of 1860 without or with minor revisions.
why register a society
- A society can be formed by a group of at least seven people. Apart from Indian citizens, companies, foreigners, and other registered societies can also register for the society’s Memorandum of Association.
- In the same way that Partnership firms can be unregistered or registered, so can societies. Only registered societies, on the other hand, will be able to endure consigned properties and/or have an ensemble filed against or by them.
- State governments are in charge of society registration. As a result, the application for society registration must be submitted to the specific authority of the state in where the society’s registered office is located.
- For society registration, the founding members must first agree on the name of the society, then draught the Memorandum, followed by the society’s Rules and Regulations.

- Information on internal affairs such as the resolution of internal conflicts and the Society’s dissolution.
- The frequency and format of the Committee and General Body meetings.
applicability of tax exemption
There is a widespread belief that society does not need to pay taxes as long as it works for the common good. However, this is not the case. Taxation is owed by a society, just like any other legal body. A society must get certification from the income tax authorities for exemptions such as Section 12 A, 80G, and others in order to be tax exempt.

The following criteria must be met in order to register a society:
- A state society must have a minimum of seven members and a minimum of eight members from eight different states (one from Delhi).
- Jurisdiction: The location of the society’s registered office. In front of the District Registrar in the specific location. In Maharashtra, for example, there is a Charity Commissioner.
- The Societies Registration Act of 1986 is the governing act for the societies.
- Property management: The property of the society is held in the name of the society and can be sold according to the terms set forth in the society’s bye-laws. (Executive Committee Member approval, for example)
- Governing Act: The Societies Registration Act governs the societies.
- Dissolution or closure: According to the society’s bye-laws, upon dissolution and after payment of all debts and liabilities, the society’s funds and property may not be distributed among its members
- instead, the remaining funds and property must be given or transferred to another society, preferably one with similar objectives.
- Executive Committee (President, Secretary, Vice President, and Treasurer), and General Body (President, Secretary, Vice President, and Treasurer) (All members)
- Annual compliance: Societies must register a list of the names, addresses, and occupations of their managing committee members with the Registrar of Societies once a year.
